Since criminal proceeding has already been initiated against you, first you need to get a regular bail by surrendering before the concerned magistrate. Alternatively, you can apply for anticipatory bail from the High/Session Court. Once you on bail, you can either file a discharge petition before the same magistrate or file an application u/s 482 CrPC before the High Court to quash the FIR/Criminal Proceeding against you.
