Franchisor Not Refunding The Money

I(Franchisee) contacted a Franchisor for setting up a school at a particular location a year back. We have paid them 5 lakhs upfront for finding a rented place and help setting up the school. We did not sign any franchise agreement with them so far. We have an email which says that if they cannot find a place or setup the school in a year they would refund the money in full. Its been more than a year and we still did not setup a school. The team who we were dealing with are no longer with the Franchisor and now the management team is not honouring the email and they are willing to give only some amount as refund. Can we approach the consumer court to get the Franchisor to refund the money in full. Thanks and Regards
