Lawyers for Consumer Matters in Punjab

Recent times have seen a rise in the number of cases filed by consumers against companies due to incidents of unsatisfactory service, fraudulent conduct, and unfair practices by the companies. The laws for consumer protection were already in place since 1980s but consumer awareness regarding these laws has risen up in the past decade. The government is spreading awareness regarding consumer rights by means of various ad campaigns like “Jaago Grahak Jaago” and has made the process of filing a complaint in the consumer court easy and quick....

This has led to a sharp increase in the number of grievances filed. Most of the complaints are related to unfair competitive practices, not delivering on promises and substandard customer follow up.

In punjab, these consumer protection laws are specified under The Consumer Protection Act, 1986 (COPRA). These laws protect consumers of both goods and services from exploitation. Under this law, Consumer Dispute Redressal Forums have been set up at various levels throughout punjab for a quick disposal of consumer disputes and also to unburden civil courts. An aggrieved consumer can file a complaint either on paper with a nominal court fee or submit his/her complaint online. The complaint will be decided by the Presiding Officer of the District Level. These consumer courts work at three different levels, namely National Consumer Disputes Redressal Commission (NCDRC), State Consumer Disputes Redressal Commission (SCDRC), and District Consumer Disputes Redressal Forum (DCDRF). NCDRC is a national level court that works for the whole country and deals compensation claimed exceeds rupees one crore. It is the Apex body of Consumer Courts and also the highest Appellate Court in the hierarchy. SCDRC works at the state level with cases where compensation claimed is above 20 lac but up to one crore. It also has Appellate jurisdiction over the District Forum. DCDRF works at the district level with cases where the compensation claimed is up to 20 lakhs. In case a consumer is not satisfied by the District Court’s verdict, he can file an appeal in the State Commission and subsequently in the National Commission. If a consumer is aggrieved by the National Commission itself, he/she can file an appeal against the NCDRC’s verdict in the Supreme Court of punjab within a period of thirty days.
