In case of non-bail able offences bail cannot be claimed as a matter of right, but instead, it is purely at the discretion of the Court, whether to grant bail or not. By virtue of Section 437(1) of CrPc, when a person accused of any non-bail able offence appears or is brought before the Judicial Magistrate, other than the High court or Sessions court, he may be released on bail by the court.
