My daughter was born in sep 2018. Due to doctors negligence she has suffered Hypoxia in the Womb. Now she is having delyed development and doctors have diagnosed her with cerebral palsy. Can i file medical negligence case against doctor and hospital.

Sir/Madam, If you have strong medical report stating that Hypoxia had been for foetus in the Womb and doctor suppressed, you can approach the Consumer Forum claiming compensation. But check through the medical reports, scan reports and doctor's opinion before claiming damages. If your medical reports supports your case, you can proceed. Else its difficult to prove medical negligence sometimes. ALL THE BEST

If the pre-delivery reports suggest that the child was normal in the womb and due to treating doctor's negligence she has suffered Hypoxia in the Womb. Please show all the reports and scans to an expert doctor and take his consultancy and if he is opined that it is treating doctor's negligence then proceed for the medical negligence case.
