Unlawful Termination And Menta

Dear All, I was working as an Senior IT consultant in a company for last 2.2 years and suddenly terminated unlawfully cause of poor performance. Before the termination they did send any warning or PIP. In last 2 yeras I was among the top performar in the office. I requested to senior manager to reconsider the termination. They asked for few times and called me for full & final settlement. I got the cheque for full & final settlement but yet not received any documents from the company. I have only the salary slip of last 6 months. After the full & final settlement they are forcing me to resign. If I resign then they will only provide me the documents. Please suggest me what are the legal way I can fight against them? Can I file a case of unlawful termination and Mental harassment? What are the IPC act I can use ? Regards, Manav

Dear manav, you can surely file a case for wrongful termination of employment under the industrial disputes act, 1947 or application under the workmen's compensation act, 1923. This might help you with either your reinstatement or awarding compensation and damages for your loss. Apart from this i would recommend you to contact a lawyer personally as there are several steps involved and brief facts are necessary to judge which type of employment you were in or whether it was a wrongful termination, to avoid any further discrepancies.
