Legal case u/s 138, 141 against my previous c...

Free Legal Advice - civil law

Respeced Sir's/Mam, I was an employee(Designation - Senior Accountant) in a company. That time on all the purchase orders was signed by myself. Our company issued 3 PDC cheques in Oct-20 to the party but 2 cheques got bounced in Feb-21 & Mar-21. Company paid 1 cheque amount through Net banking in Feb/Mar. The party filed a case u/s 138 & 141 in April-2021 against my previous company including me for both cheques. Liability is more than the both cheques amount. I resigned in December-2020 and joined another company in January-21. They mentioned me as accused No.4. How an employee is responsible for paying company dues or why they are involving me. Two hearings already done but no one present from my previous company and I also not present for hearing. Today I received Summon. What should I have to do in this situation??

Ancestral Property

Free Legal Advice - civil law

Dear Sir, My husband’s grandfather had 15 Acres of self-earned Agriculture Land. He registered this property for my father-in-law on 1964. My Father-in-law has a wife and 2 sons. My father-in-law died on 1995 and he didn’t separate that above mentioned property to his family members. After My father-in-law’s death, his property was partitioned and registered in his wife and 2 son's Names according to legal inheritance on 2003. Everybody segregated each 5 Acres. My husband is a 1st Son of my father-in-law. After that we had married on 2014 and we had a first baby on 2015. My husband sold that property to other person on 2016. He mentioned that the property is going to sales for me and my child's future welfare in the Sale Deed. Sale Deed is signed by only my husband in our side. At that time we had one child. After that we had also second child. I was revealed that the property was sold by my husband without my knowledge in 2019. After that I raised the regular civil suit in the court. In this case I had mentioned that this property is our ancestral property. My husband sold that property without court permission. He didn’t spent any amount to our family needs. He spent the full amount lavishly. Now we are not living together in the same house. I am living separately with my 2 children in my father’s house. So we request the honourable court that we need to be redeemed our ancestral property and also my husband have to give me and my children maintenance. Can me buy a Stay Order not to use that property until the judgement of this case comes?. And please suggest me also if there is any possibilities for favourable judgement in the above case to us.

regarding civil suit

Free Legal Advice - civil law

When we file a civil suit in Gujarat, it is featured under, say for example 1) SRA1963 section 34 2)CPC 1908 order 39 rule 1 & 2.My question is that, will it be discussed and disposed under these two acts only? whether the case can be discussed and disposed on the basis of some other Act? 3) Is it allowed to change the already featured acts while the case is on? 4) Are plaintiff or defendents allowed to change the featured acts, say for example, Hindu Succession Act 1956?

Right of partition in a purchased joint prope...

Free Legal Advice - civil law

We have purchased 2/3rd share in a land from Mr. A & B.. Another person purchased remaining 1/3rd share of land from Mr.C.. I understand that earlier this entire land pertains to one person and he has sold it in 3 shares to Mr. X, Y and Z without describing seperate boundary for each share.. and X Y and Z inturn sold it to Mr. A, B and C from whom we purchased our 2/3 rd share of land.. Now the other person who purchased the remaining 1/3rd of land is not allowing us to do agriculture in our 2/3rd share of land and asking us to exchange his 1/3rd of land with our any one 1/3rd share because his 1/3rd of land has less water capacity.. His argument is that it is a joint property because there are no seperate boundaries for our 2/3rd share and his 1/3rd share and he can take any 1/3rd share in the joint property.. but we are unwilling to exchange the share.. Please guide us on whether it is a joint property ?? Is his contention valid ?? If we go to court, who has the possibility of winning the case.
